If employee works for employer through an independent contractor (farm labor contractor), the independent contractor must provide workers' comp. The employer/grower may be secondarily liable if the independent contractor fails to provide workers' comp. Haw. Rev. Stat. § 386-1 (2003) definition of "employee."
