Coverage for Farm Workers: Required (with limitations)
Limitations: Employers that are "family farms" do not have to provide workers' compensation. Family farm is defined as a farm operation that pays wages, exclusive of machine hire, to farm laborers for services during the previous year (1) that are less than $8,000; or (2) that are less than the state average annual wage, if the farm operation has total liability and medical payment coverage equal to $300,000 and $5,000, respectively, under a farm liability insurance policy, and the policy covers injuries to farm laborers.

Coverage for Undocumented Workers: Yes
Case Law: Correa v. Waymouth Farms, Inc., 664 N.W.2d 324, 329 (Minn. 2003) (holding that Immigration Reform Control Act (IRCA) did not prevent state from awarding workers' compensation benefits to unauthorized aliens and thus alien, who medically was released to work with restrictions, was not prohibited by Act from conducting a diligent job search as a condition of receiving temporary total disability benefits under state's workers' compensation law).
Benefits Available for Undocumented Workers: Undocumented workers are eligible for temporary total disability benefits, even though this requires diligent job search as a condition of receiving such benefits. Correa v. Waymouth Farms, Inc., 664 N.W.2d 324, 330 (Minn. 2003).
